Negligence

If a person or company is proved to have been negligent in his, her or its behaviour (i.e. acts or omissions to act) and by that negligence have caused loss to another party to whom there was owed a duty of care, then there may be rights of claim for damages that result from that loss.

There are many categories of negligence extending from professional advice through to building construction issues and to negligent misstatement.

Complex considerations of fact and legal principles arise. First, as to whether there was a duty of care owed. Second, as to whether there has been negligence in circumstances where a duty was owed. Third, whether that has been causative of damages or loss and, if so, what those damages or that loss are. There are time limitation questions to be addressed.
