For any person injured in any circumstance there are consequences. These may be minor but they may be major.
The first consideration is cover for accident compensation and the extent of entitlements.
The second is whether there is any recourse for other damages, such as exemplary damages.
Southern Cross Chambers members can advise on accident compensation cover and entitlement and can assist with recovery of entitlements if it is claimed that these are not being provided. They can also advise on other entitlements for damages, if any.
Allied to this is the complaint procedures in respect of the particular professional and damages recovery procedures under the Health and Disability Commissioner Act 1994. It may be that the case is one for professional complaint on standards (see topic below under "Professional Discipline"). In that case a complaint can be structured so as to be mounted most effectively. It may be a case for complaint to the Health and Disability Commissioner with consequential proceedings for recovery of further damages.
