Mediation and Alternative Dispute Resolution

Litigants often seek an alternative to the dispute resolution procedures of the Courts which can be time consuming, detailed, stressful and expensive.

There are several alternatives. One is mediation, where the parties at an appropriate and relevant time meet face to face and with an independent mediator to present the main arguments of their case, to listen to the main arguments of the other party or parties and to seek a compromise solution having regard to the conflicting positions taken and the perceived strengths and weaknesses of each party's position.

Our members include specifically trained and experienced mediators who can assist with that process including the proposal for the course of mediation and putting it in place. Those mediators can assist with the process and use their expertise in communication to assist in the finding of a mutually acceptable solution.

Other members in our Chambers can assist as counsel for the mediation, advising where strengths and weaknesses lie and where compromises may be considered.
