Land Law

Members at Southern Cross Chambers have significant experience and expertise in all issues concerning land.

Land law extends widely and land law disputes are varied. They include questions relating to the sale and purchase of land and the rights and obligations that flow from agreements for sale, including contractual and statutory issues as to enforceability of such agreements. They include issues concerning easements and the right of another person to have access to a block of land or to use part of it for another purpose such as drainage, electricity power flow and also rights of way. They include questions of interests in land, whether as lessee, mortgagee or purchaser. Other issues may include questions of entitlement to register a caveat to give notice of a claimed interest in land and the procedures for removal of a caveat wrongly entered against a title.

Our members with their extensive experience can advise on the legal rights that there are and on the legal obligations that there are and can assist with the processes of enforcement of rights or opposition to wrongly claimed rights.
