There are occasions when urgent action is required to prevent the breach of legal rights. This may be in the context of removal of a tree or destruction of property on an adjoining site required to be prevented; or it may extend to the breach of commercial rights in relation to abuse of material such as threatened breach of copyright or trademarks rights or other intellectual property or contractual rights. There may be questions of abuse of privacy which require immediate attention. Defamation or damage to reputation is an area where injunctive relief is often sought.
There may be Anton Piller orders required (for legitimate access to premises to search for and seize documents, computers or other property), Mareva injunctions or the like to prevent the removal of property offshore or out of an entity and so frustrate debt recovery, injunctions to prevent passing off, breach of trademarks or copyright or patent rights; or injunctions to enforce positive obligations such as restrictive covenants.
The Courts are equipped to deal with issues of this kind with urgency but there is paperwork and there is urgent collation of material for presentation to the Court required in order to obtain an injunction.
