Family Law

The laws relating to family and domestic relationships and relationship property rights and liabilities are complex. There is the added overriding consideration of emotional and personal relationship tensions. The procedures and practises for resolving dispute between family members or domestic partners are also complex.

Topics covered by this area of the law include dissolution of marriages, resolution of property disputes between spouses or de facto partners; resolution of questions of care for children and how this is to be adequately done in their interests by either or both parents or by others involved in their lives, questions of maintenance and care for a spouse or partner and/or children, reimbursement to the State for any domestic purposes benefit paid; and holiday arrangements between parents, and child support. There are also issues concerning the Children, Young Persons and their Families Act 1989 which address the care and safety of children, responsibilities of parents, prevention of crime by children, and the adequate and proper care of children either by parents or by caregivers. There are also cases of crime in relation to children and young persons.
