Competition Law

The law encourages competition. That can affect prices and the quality of goods and services. If there is a competitive market, then there are commercial incentives to efficiency and cost saving but maintaining quality. However, price competition must not be unduly at the expense of the quality of goods or services.

The Commerce Act 1986 and Fair Trading Act 1986 are aimed at trying to achieve that balance. They address questions of monopoly, price fixing and misleading and deceptive conduct in trade, mergers and acquisitions, price control and anti-competitive trade practises. They protect the consumer and also regulate trade and dealing between providers of goods and services.

Our members have experience in these areas, including Commerce Commission investigations and prosecutions as well as in civil claims between individuals, or individuals and companies.
