Adjudication is an increasingly popular method of dispute resolution, particularly in the construction industry. Adjudications are provided for in the Construction Contracts Act and in the Weathertight Homes Resolution Services Act but are available (by agreement) for other types of dispute resolution.
Instead of going to Court or having a more formal arbitration, the parties can agree on an adjudication process which achieves an outcome provided it is done fairly with both parties being heard. It might not necessarily cover every aspect of the dispute but, provided the parties agree, that may be an outcome which is more acceptable.
Adjudications under the Construction Contracts Act, the Weathertight Homes Resolution Services Act and the Retirement Villages Act will be conducted by an adjudicator under the procedure prescribed by those Acts.
Some of our members have been trained as adjudicators and have acted in that capacity in many disputes, particularly Construction Contracts disputes. They are familiar with the robust procedure required to achieve an outcome.
Other members are familiar with the process and can advise parties to an adjudication on how to conduct their case in the way that will most effectively present it and act as Counsel in those matters.
